Kelly: Unclear Why Empire State Shooter Chose Day

New York Police Commissioner Raymond Kelly says the man who shot a former co-worker to death outside the Empire State Building last week had given notice to his landlord that he was leaving and not returning.

Kelly said Jeffrey Johnson's landlord wanted him out temporarily to do work, and Johnson told him that "things would be taken care of."  Johnson left his keys and said he wouldn't be back after Friday - the day of the shooting.

It's not clear why he chose last Friday.

Police shot and killed Johnson when he pointed a gun at them after killing former co-worker Steven Ercolino. As police confronted Johnson, nine bystanders were wounded in the crossfire by police bullets, ricochets and fragments. They suffered non-life-threatening gunshot and graze wounds.

Ercolino's funeral was held Wednesday. His relatives remembered him as a warm and witty member of a tight-knit family.
